Here you will find details of developers whose loans are reported to be NAMA-bound, the companies and individuals with whom they’re associated (or have been associated) and assets linked to them (again presently or in the past). You will also find details of developers and bankers who have not been publicly associated with NAMA, and indeed may never be – they are owners of property that goes beyond a private residence. There are also overseas property owners with publicised links to Irish banks.
Note that NAMA has said that it will not normally reveal the identities of any NAMA borrower and will accord NAMA borrowers the same confidentiality they would receive at the original financial institution. The identities of the NAMA borrowers in the attached spreadsheet and below are based on press reporting – the reporting sources are shown on the spreadsheet . An updated spreadsheet list is maintained here. An extract from that list will be regularly posted below. The list includes the borrower, associated companies or individuals and associated assets (note any association might be past or present – the press sources for any information are shown in the comments fields). Not all the information may display below depending on your browser settings – to access all the information, you need to access the google docs spreadsheet above. This may sound silly, but are the associated individuals involved financially with the respective developer?
Depends on what you mean by individuals. Remember with most of the bigger developers they will have used companies as vehicles to buy and develop (or own and manage) property. So take Paddy McKillen – he is taking a limited action (in respect of an estimated €80m of loans out of a reported total of €2bn) with 15 of his companies whose loans are NAMA-bound, he has many other companies whose loans might also be earmarked for NAMA. And in that case, it has been determined by NAMA that these are associated loans I would guess on the basis of the companies being controlled by, or having a shareholding owned by, Paddy McKillen.
Hmmm… Not quite right. Most large developers used companies as vehicles to buy, develop and sell property. Most of the properties that were held for investment purposes were held in individual names or through trusts so that they could avail of the capital allowances on a personal basis.
Will take your word for it – the ones I know who mostly developed overseas would have a few dozen Luxembourg registered SPVs (for the pros) and BVI/Panama/Gib registered SPVs (for the more marginal ones). Property wasn’t personally owned and there was very limited use of trusts – maybe that’s because Irish tax liabilty was not seen as such an issue.
A question; how many of the politicoes mentioned in the listing above, voted in the Oireachtas for the NAMA legislation and did they declare an interest in the matter as they did so ?
An answer: I honestly don’t know but if you want to do a search on the names above (or in the spreadsheet) and compare the deputies with the voting record for NAMA (the debate on 12th which was of the Seanad’s amendments and votes are below – you could also consult the Dail on 4/5th November 2009) then I’d be grateful if you’d let us know. My impression is that a small number of FF deputies and senators are above or in the spreadsheet (<10) and there is a peppering of Labour and FG also. The list above is by no means a complete list of those associated with developers or developments. I certainly don't know whether it is fair or accurate to describe FF as the developers party.

Well, the gloves are coming off! This letter (or similar) has just recently been sent out to a few of the “early” Nama developers.
I have always maintained that the “end game” between the developers and Nama would relate to Personal Guarantees.
I would not say that battle is engaged yet, but this does look like one of the first shots – or maybe it’s just a probing reconnoiter by Nama.
The developers’ reaction will be interesting. One would assume that most wives are independent citizens and have rights as such. Therefore it is hard to see on what basis Nama can demand personal and financial information on them from a husband. I would think that many will seek independent legal representation. It will be intriguing to see how this plays out.

Dear -,
I refer to the statement of affairs in respect of XXX and the listing of property transfers which you submitted to us as part of the recent business plan submission.
To finalise this information, NAMA requires that xxx principals submit a final, signed, comprehensive and itemised listing of all asset transfers to connected parties (including spouses and other family connections if applicable) over the past five years. This list should detail the date of transfer and where relevant, the consideration paid.
In addition, NAMA requires a final. signed and comprehensive listing of all assets currently held for each of the principals, and separately for each of their spouses. The listing of assets should be itemised , subject to a financial threshold of €10k for personal assets and house contents, and should include a full breakdown of all properties, cash, personal assets, house contents and all other assets, detailed by the partnership, corporate entity and trust in which they have a beneficial interest or in their own name. I work for one of the developers on your list and know many others; your list only contains public knowledge not the real bad stuff, fields all over the country now only good for farming outstanding loans of well over a million an acre. They are now worth about 20 k an acre before any fire sale and will never be developed.
There was a belief amongst developers that the market was going to collapse from 2004 however that they would know well in advance via Sean Fitzpatrick, Brian Goggan and Ken Macdonald and be able to sell at massive reductions to investors via financial advisors and clear their loans.
There may well have been a belief amongst develops that it would collapse in 2004/2005.
The banks knew it too. They started to issue 100% mortgages at that time. Why? Who made that decision? It was an unusual banking decision.
One wonders if our new regulator has had the time to check the 100% mortgage decision.
It seems in hindsight that it was designed to prop up the demand side because the banks already knew that developers were in trouble and only a buying spree would save them.

I am writing the question from abroad: Since NAMA is involved in selling of a one of overseas assets of a developer listed above, who should be dealing with payment claims (local subcontractors, architects, consultants and other services), regarding the property development there? Where can I find such information?

Nama builders presenting “strong balance sheets” with their financial info for prequals. On examination if public bodies knew how; one could see that their debtors are property companies owned by themselves or group companies. Financial engineering to show they are profitable and solvent when in fact the opposite may be true if current property values were used. If public bodies could be alerted to this the select tender lists might be easier to get onto.
Any further updates on the Progress of Developers Business Plans being approved by NAMA,If so is there a list available of same
@Patrick, other than NAMA saying on Tuesday that it had reviewed 40 business plans (see the NAMA presentation in Cork linked to in the post on Tuesday), no nothing official. No update on “agreed plans” at all. There has been a marked fall-off in enforcement activity in the past five weeks, with only one (minor) new receivership reported on here last week. There has certainly not been any high profile scalp since the Grehans at the start of May 2011. That might be because the Grehans raised some important points on receivership generally, in their subsequent High Court application, but that was defeated at the start of this week.
The volume of public shield-banging by NAMA has also been toned down. For all of that, I know there are a lot of intensive, and indeed sensitive, negotiations going on at present. But no update, sorry.
As a ‘member’ of NAMA….I must update you, my plan being submitted in the
coming weeks…I can’t understand why noone else in namaland is!!
My understanding is that NAMA is working in stages in typical civil service fashion and that it is still in the “collection of information” box. It has not yet really addressed the marketing phase, especially in Ireland. NAMA is aware of the need to keep to the agreed programme and dispose of 25% of the loan book before (the end of?) 2013.
Logic dictates that these disposals should not all be in London and there is a need to begin the process of disposing of some Irish assets. Hence we will see a move to market portfolios of Irish loans out of NAMA before the end of this year.
Although there has been a relative hiatus in terms of receiver appointments, this will change dramatically in 2012 as the assessment of developers’ business plans are concluded. At that point we will see the birth of NAMA’s sectoral REITs, whereby the income producing properties in receivership will be parceled into retail, commercial or residential packages, warehoused and then eventually (it hopes!) sold to investors and property funds.
Of course, warehousing of receivership properties does not answer NAMA’s brief, which is to sell the assets. It is just kicking the can down the road and producing a nice little earner in the interim, so that it’s profitability can be fudged. It also creates “jobs for the boys” to manage its spanking new nationalised property funds.

After doing some research over the past 2 weeks, I have come to find that many of the larger hotel/commercial properties on this list have been moved through the process and are now under new ownership. When can we expect to see a fuller and updated list? Thank you for your hard work.
@Andrew, the above lists are frequently updated, generally weekly. Please refer to the notes above, association with an asset might be past or present, you need to refer to the comment (typically a newspaper report or corporate press release or accounts) to see the association.
